Stop Repossession Before Its Too Late!

Remember that you can stop repossession anytime. Repossession may occur due to reasons like failing to meet the mortgage arrears, going through a separation, carrying financial debt, suffering from poor health, undergoing a trauma, carrying excessive secured loans debt etc. Ensure that you settle the matter with your lender in the first place. Repossession can be stopped in any one of the following ways:
  • Show that you have a buyer for your house.
  • Show that you can pay the mortgage every month.
  • Sell your other assets or take out a new mortgage.

The ordeal of facing repossession can be extremely nerve racking. It is a clear indication that your financial situation is not good once you stop paying the mortgage amount. What can be even more irritating is the fact that you have paid most of the mortgages and have very few left.

In case you receive letters from you lenders asking for outstanding payment do not ignore them. Always remember that the process of repossession of property is very expensive for the lender; therefore, they would always prefer settling the issue with you.

Remember that the primary aim of the lender is to get the payment arrears from you and not repossession. Even before legal action has been instigated talk to your lender about your monetary situations. Chances are that they many consider you situation if you let them know that you are on the lookout for a new job or arranging for finances.

Rent back options to deal with stopping repossession:

Consider the rent back options provided by some of the companies. These companies rent your house to you and pay the mortgage amount. You can buy back the property once your situation improves.

When to seek professional advice to stop repossession:

In case you fail to reach an agreement with the lender and have received a legal notice look for some professional advice. There are various organizations that offer advice and prevent repossession of your homes.

How to deal with court order:

If you have received the court summons asking you to appear before the court for hearing seek professional advice immediately.

Judgment:

After hearing both the parties (you and the lender) the court will decide the issues based on the merits of the case. You must also demonstrate that you can pay the monthly installment as well as the arrears amount to stop repossession. The court may also give time to find a suitable buyer, revamp your financial situation, time to repay the debt etc. In case the court gives an eviction order, you should evict from the property within the stipulated time. Otherwise you will be evicted forcibly by the bailiffs. Even after repossessing your property, you could still be liable to pay all the ongoing costs involved with the sale of your property, which may include estate agents, mortgage interest, legal fees, etc.
